These terms apply between you and René Weinhold, Merlinweg 14, 44229 Dortmund, Germany ("we", "us") for use of the iOS app Muscles ("App") and the website muscles-app.com.
1. Acceptance
By creating a Muscles account you accept these terms. If you do not agree, please do not use the app. We may update these terms - the current version is always shown on this page with the date at the top. Material changes are announced in advance in the app or via email.
2. Eligibility
- You are at least 16 years old (or older if your country requires).
- You comply with these terms.
- You have not previously been banned from using the service.
3. Your account
You sign up with your email address and a password of your choice or via "Sign in with Apple". You alone are responsible for keeping your credentials secure. If you suspect someone else has access to your account, change your password immediately and contact us.
4. Service & changes
We continuously evolve Muscles - new features are added, others are reworked or removed. Material changes are announced in advance. A complete shutdown of the app is not planned; if it becomes unavoidable, we will inform you in time.
5. Acceptable use
We grant you the right to use the app personally. You may not:
- use the app commercially without our consent,
- use copyrighted content without permission,
- impersonate our staff or partners,
- interfere with the service (DoS, manipulation, reverse engineering, scraping),
- misuse APIs we provide,
- conduct security research without our consent,
- violate applicable law.
We may suspend or terminate accounts that breach these rules.
6. In-app purchases & subscriptions
6.1 Overview
Muscles offers two paid subscription tiers:
- Monthly - $5.99 per month
- Yearly - $44.99 per year
Prices may vary by region. Local taxes and currency conversions are shown by the App Store.
6.2 Free trial
A subscription may start with a free trial (typically 7 days) if you have not used one before. If you do not cancel at least 24 hours before the trial ends, the trial automatically converts into the chosen paid subscription.
6.3 Auto-renewal
Subscriptions auto-renew at the then-current price at the end of the current period unless you cancel at least 24 hours before renewal. Billing is handled by your Apple ID.
6.4 Manage & cancel
You can manage or cancel your subscription at any time at Settings → Apple ID → Subscriptions on your iPhone. Cancellation takes effect at the end of the current period - you can keep using Muscles until then. Important: deleting the app or your Muscles account does not cancel the subscription. The subscription must be cancelled separately in the App Store.
6.5 Refunds
Refunds for purchases made through the Apple App Store are handled exclusively by Apple. Request via reportaproblem.apple.com or through the App Store on your device.
6.6 Right of withdrawal (EEA consumers)
Consumers residing in the European Economic Area have the right to withdraw from a contract within 14 days without giving a reason. Once the contractual service has begun (subscription activated) this right expires under § 356(5) BGB if you have expressly consented. Apple also handles withdrawal requests as part of its refund flow.
7. AI meal recognition
The AI meal-recognition feature is intended only as an estimate of calories and macros. Results can be inaccurate and are not a substitute for professional nutritional or medical advice. They are not suitable for medical, dietary or clinical decisions. You use this feature at your own responsibility.
8. Health disclaimer
Muscles is a tracking app, not a medical device. Plans, recommendations or statistics provided in the app (including calorie targets, training suggestions and personal-record logic) are not medical advice. Consult a qualified medical professional if you have any health concerns.
9. Intellectual property
The app, its contents (other than data you enter) and our trademarks are protected by copyright. We grant you a non-exclusive, non-transferable right to use the app under these terms.
10. Liability
We have unlimited liability for damages resulting from harm to life, body or health, and for damages caused by intent or gross negligence. For ordinary negligence, we are only liable for breaches of essential contractual duties, limited in amount to the foreseeable damage typical for the contract. Liability under the German Product Liability Act remains unaffected.
11. Account closure & termination
You may delete your account at any time in the app under Profile → Settings → Delete account. We may terminate your account in case of a material breach of these terms. In case of termination by us due to a breach, no refund of already-paid amounts is owed.
12. Governing law & venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of your country of residence remain unaffected. The venue for merchants, public-law entities and special public-law funds is Hagen, Germany.
13. Online dispute resolution
We are neither obliged nor willing to participate in dispute- resolution proceedings before a consumer arbitration body. The EU's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
